This is a translation for your convenience. Only the German version is legally binding.
1. Scope
- 1.1These terms and conditions apply to contracts for the rental of hotel rooms for accommodation and to all other services of Boutique Hotel Kerlin, operated by Kerlin Hospitality e.K. (hereinafter the “Hotel”).
- 1.2Subletting or re-letting the rooms provided is prohibited without exception. Use for purposes other than accommodation is likewise prohibited unless the Hotel has expressly agreed to it in advance in text form. In the event of a breach, the Hotel is entitled to withdraw immediately or to terminate without notice; the agreed price remains due.
- 1.3The customer’s general terms and conditions only apply if this has been expressly agreed in advance in text form.
2. Conclusion of contract, contracting parties, limitation
- 2.1The contract is concluded when the Hotel accepts the customer’s request. The Hotel is free to confirm the booking in text form.
- 2.2The contracting parties are the Hotel and the customer. If a third party has booked on behalf of the customer, they are jointly and severally liable to the Hotel together with the customer.
- 2.3All claims against the Hotel are generally time-barred one year after the statutory start of the limitation period. Claims for damages become time-barred after five years. These shortened limitation periods do not apply to claims based on an intentional or grossly negligent breach of duty by the Hotel, or to damage resulting from injury to life, body or health.
3. Digital communication
- 3.1The Kerlin is a digital hotel without a reception desk. The Hotel sends the booking confirmation, arrival information, door codes and information during the stay via a digital guest communication service by WhatsApp and/or email to the contact details provided when booking. This communication is necessary for carrying out the stay.
- 3.2The customer may object to communication via WhatsApp at any time, by sending a message with the word “STOP” to +49 30 8871650 or by email to hotel@kerlin.berlin. They will then receive all information by email only.
- 3.3The customer should preferably send enquiries and change requests by email to hotel@kerlin.berlin.
4. Services, prices, payment, set-off
- 4.1The Hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services. If this is not possible due to circumstances for which the Hotel is not responsible (e.g. burst pipes, severe weather, power or heating failure, official orders, force majeure), the Hotel may offer an equivalent replacement room in the house or comparable accommodation nearby. Otherwise, the Hotel will refund amounts already paid for services not provided. Further claims by the customer, in particular for damages, are excluded in these cases.
- 4.2The customer is obliged to pay the agreed or applicable prices of the Hotel for the provision of the room and for the other services used. This also applies to services and expenses of the Hotel to third parties arranged by the customer. Prices include statutory VAT. The Berlin City Tax (accommodation tax) is not included in the room price. For direct bookings it is already shown in the total amount. If it was not charged with a booking made via a booking platform, it must be paid to the Hotel in addition.
- 4.3The room price depends on the number of guests booked. For each additional person added later, the Hotel charges a supplement according to the current price list.
- 4.4The Hotel may make its consent to a subsequent reduction in the number of rooms, the services or the length of stay conditional on an increase in the price for the rooms and/or other services.
- 4.5The Hotel is entitled to request an advance payment or security deposit when the contract is concluded and to make pre-authorisations on credit cards provided as security. For the non-refundable rate, the full price is due immediately upon booking.
- 4.6Invoices from the Hotel for services not paid in advance are payable without deduction within 7 days of receipt. In the event of late payment, the Hotel is entitled to charge a flat fee of €25.00; the customer remains free to prove that the damage was lower.
- 4.7In justified cases, e.g. payment arrears, the Hotel is entitled to refuse further services.
- 4.8The customer may only set off an undisputed or legally established claim against a claim of the Hotel.
5. Withdrawal by the customer (cancellation, no-show)
- 5.1The cancellation terms of the booked rate apply:
- Non-refundable rate: no free cancellation is possible from the time of booking. The full price is due immediately and will not be refunded in the event of cancellation, no-show or early departure.
- Standard direct booking rate: free cancellation until 6 pm on the day before arrival. After that, and in the event of a no-show, the Hotel charges 90 % of the agreed room price.
- Bookings via booking platforms: free cancellation until 6 pm two days before arrival. After that, and in the event of a no-show, the Hotel charges 90 % of the agreed room price. Different terms stated in the platform’s booking confirmation take precedence.
- Long stays, co-living and serviced apartments: no free cancellation is possible from the time of booking. The agreed price must be paid in full.
- Group bookings and exclusive bookings of the whole house: separate cancellation and payment terms apply, which are agreed in text form in the respective offer.
- 5.2Cancellations must be made in text form (e.g. email).
- 5.3Note: there is no statutory right of withdrawal for hotel bookings (§ 312g (2) no. 9 BGB, German Civil Code).
6. Withdrawal by the Hotel
- 6.1If an agreed advance payment or an advance payment requested in accordance with clause 4.5 is not made even after a reasonable grace period has expired, the Hotel is entitled to withdraw from the contract.
- 6.2The Hotel is also entitled to withdraw from the contract for an objectively justified reason, in particular if
- force majeure or other circumstances for which the Hotel is not responsible make performance impossible;
- rooms are booked with misleading or false information about essential facts;
- there is reasonable cause to assume that the use of the service may jeopardise the smooth running of the business, the safety or the reputation of the Hotel;
- there is a breach of clause 1.2.
- 6.3If the Hotel withdraws justifiably, the customer has no claim to damages.
7. Arrival, check-in, check-out
- 7.1The customer is not entitled to the provision of specific rooms unless this has been expressly agreed in text form.
- 7.2Check-in is done independently at the self check-in kiosk. Booked rooms are available from 3 pm on the day of arrival. There is no entitlement to earlier availability. If the room is ready earlier, an earlier check-in at the kiosk is possible; the Hotel does not provide individual information on this.
- 7.3On the day of departure, rooms must be vacated by 11 am at the latest. A late check-out is not offered. In the event of late vacating, the Hotel may charge 100 % of the full room rate (list price) for use beyond the contract until 2 pm.
8. House rules
- 8.1Dogs are only allowed in ground-floor rooms and only if registered in advance. The Hotel charges €20.00 per dog per night. Dogs may only stay alone in the room if they remain calm. The customer is liable for damage caused by the dog.
- 8.2Smoking and vaping of any kind – cigarettes, e-cigarettes, vapes, heated tobacco products, shishas and comparable products – is prohibited throughout the building. Outdoors, out of consideration for other guests, please do not smoke or vape directly in front of the entrance or in front of the windows. In the event of violations, the Hotel charges a flat fee of €150.00 for special cleaning and loss of room use; the customer reserves the right to prove that no damage or less damage was incurred.
- 8.3For fire safety reasons, batteries of e-bikes and e-scooters may not be taken into the room or charged there. Charging is only permitted under supervision at Space37 during opening hours. The customer is liable for damage resulting from non-compliance.
- 8.4Quiet hours are from 10 pm to 7 am.
- 8.5The building is a period building without a lift; the rooms are reached by the stairs.
- 8.6House rights: the Hotel exercises its house rights at all times. In the event of violations of these house rules, harassment or endangerment of other guests or staff, disrespectful behaviour, damage to property or other disturbance of the peace, the Hotel may end the stay without notice and ask the customer to leave the premises. In this case, the agreed price remains due less saved expenses; further claims for damages by the Hotel remain reserved. The customer is liable for damage and unusual soiling; the Hotel will invoice the costs of special cleaning, repair or renovation as well as the resulting loss of room use.
9. Liability of the Hotel
- 9.1The Hotel is liable for its obligations under the contract. Claims for damages by the customer are excluded. This does not apply to damage resulting from injury to life, body or health if the Hotel is responsible for the breach of duty, to other damage based on an intentional or grossly negligent breach of duty by the Hotel, or to damage resulting from an intentional or negligent breach of obligations typical for the contract. If disruptions or defects occur, the Hotel will endeavour to remedy them as soon as it becomes aware of them or upon the customer’s immediate complaint. The customer is obliged to contribute what can reasonably be expected of them to remedy the disruption and to keep any possible damage to a minimum.
- 9.2The Hotel is liable for items brought in by guests in accordance with the statutory provisions (§§ 701 ff. BGB), i.e. up to one hundred times the room price for one day, at least €600.00 and at most €3,500.00, and for money, securities and valuables at most €800.00.
- 9.3If a parking space is made available to the customer, even for a fee, this does not constitute a safekeeping contract. The Hotel is only liable for loss of or damage to parked vehicles and their contents in the event of intent or gross negligence.
- 9.4The Hotel accepts mail and deliveries for guests without guarantee; liability for loss or damage is excluded. Perishable items, food and toiletries are disposed of immediately. Other items left behind are kept by the Hotel for 4 weeks from departure and then disposed of without further notice. Identity documents and valuables are handed over to the lost property office. Items are only forwarded on request and at the customer’s expense; clause 9.1 sentences 2 and 3 apply accordingly.
- 9.5The Hotel is not liable for services provided by third parties (e.g. airport transfer); the contracting party is the respective provider.
10. Final provisions
- 10.1Amendments and additions to the contract or to these terms and conditions should be made in text form. Unilateral changes by the customer are invalid.
- 10.2The place of performance and payment is the location of the Hotel.
- 10.3German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- 10.4Should individual provisions be or become invalid, the validity of the remaining provisions shall not be affected. In all other respects, the statutory provisions apply.
- 10.5If the customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction is Berlin.
